These Terms of Use govern access to and use of ChefIApp™ OS, a software-as-a-service (SaaS) platform operated by Goldmonkey Studio LLC, incorporated in Cheyenne, Wyoming, USA.
By accessing or using ChefIApp™ OS, you agree to be bound by these Terms. If you do not agree with any provision, you should not use the service.
1. Operating Entity
ChefIApp™ OS is operated by Goldmonkey Studio LLC, a company incorporated in the state of Wyoming, USA. For any service-related inquiries, contact us at contact@goldmonkey.studio.
2. Service Description
ChefIApp™ OS is a restaurant operating system that includes Point of Sale (POS), Kitchen Display System (KDS), staff management (AppStaff), menu builder, reservations, operational analytics, and management tools. The service is delivered as a progressive web application (PWA) accessible on any device with a browser.
3. Registration and Account
Access to ChefIApp™ OS requires creating an account. You are responsible for maintaining the confidentiality of your credentials and for all activities conducted under your account. You must provide accurate and up-to-date information during registration.
4. Plans and Billing
The service is offered under monthly subscription plans (Starter, Pro, Scale, and Custom). All plans include a 14-day free trial. No per-transaction fees are charged on any plan. Billing is monthly and can be cancelled at any time without penalty.
5. Acceptable Use
ChefIApp™ OS is intended solely for operational management of restaurants and hospitality establishments. You agree not to use the service for unlawful activities, not to attempt to access other users' data, and to comply with all applicable tax and legal obligations in your jurisdiction.
6. Intellectual Property
ChefIApp™ is a trademark of Goldmonkey Studio LLC. All software, design, documentation, and service content are the property of Goldmonkey Studio LLC or its licensors. You retain full ownership of your operational data (orders, menus, staff data, reports).
7. Limitation of Liability
The service is provided 'as is'. Goldmonkey Studio LLC does not guarantee uninterrupted availability. In no event shall Goldmonkey Studio LLC's total liability exceed the amount paid by you in the preceding 12 months of subscription.
8. Termination
Either party may terminate at any time. You may cancel your subscription through the billing section in the application. After termination, you may export your data for 30 days. Goldmonkey Studio LLC reserves the right to suspend accounts that violate these Terms.
9. User Content and Copyright
You may upload content to the service (logos, product photos, menus, documents, ambient music, and other files). You retain ownership of that content and grant Goldmonkey Studio LLC a limited license to host and display it solely to provide the service. You warrant that you hold the necessary rights to everything you upload and that it does not infringe third-party rights. Copyright infringement notices (DMCA) should be sent to our designated agent: Copyright Agent, Goldmonkey Studio LLC, 1021 E Lincolnway, Suite #8568, Cheyenne, WY 82001, USA — contact@goldmonkey.studio (U.S. Copyright Office registration DMCA-1076663). Infringing content will be removed upon valid notice, and repeat infringers' accounts may be terminated.
10. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of Wyoming, USA, without prejudice to mandatory consumer-protection rules of your jurisdiction. Any business-to-business (B2B) dispute arising from these Terms shall be resolved by binding individual arbitration, with a waiver of class actions, except for small-claims actions or injunctive relief to protect intellectual property. Nothing in this clause limits non-waivable statutory consumer rights.
